Our Employer Covenant advisory services

The Pensions Regulator’s 2024 defined benefit funding code has significantly increased the requirements for covenant assessments, and for the first time, assessing the Employer Covenant is now a statutory requirement.

Trustees and Employers need to consider as a minimum

  • Affordability and maximum affordable contributions
  • Contingent assets

This makes it ever more important that you get the right advice at the right time to ensure compliance and protect members’ benefits.

Our highly experienced team of Pensions specialists can assist Trustees and Employers throughout the United Kingdom in meeting their obligations by providing an independent assessment which is proportional to your scheme’s risk profile and funding level.

An independent covenant review can be beneficial during negotiations between the trustees and employer by providing guidance on what the employer can afford to pay and over what timescale. It can also assist the Trustees in considering whether steps should be taken to reduce the level of the risk-based Pension Protection Fund levy.

We are able to provide Trustees and Employers with a range of specialist support services including:

  • Desktop review, based on publicly available information.
  • Detailed review, involving the review of confidential company management information.
  • Assisting with ongoing monitoring of the covenant.
  • Review of proposed transactions e.g. company merger or other corporate transactions.
  • Assistance with the negotiation of a recovery plan.

Sustainability

As a firm, we understand our duty to reduce our environmental impact and are fully committed to being a responsible, sustainable business.  In conjunction with Carbon Footprint Ltd, BHP assessed its carbon footprint for the second year running and showed a reduction from the baseline year, measured by absolute emissions. We are delighted with this result, but we won’t stop there. We will continue to conduct these reviews to ensure we are doing everything we can to work toward becoming a carbon-neutral firm.

Cyber security, data security and business continuity

At BHP, we take cyber and data security very seriously. We have detailed a Business Continuity Plan, GDPR and IT risk policies in place (including cyber security), and as a firm, we are working towards the Cyber Essentials Plus accreditation.

All personal data held by the firm is destroyed in accordance with our destruction and file retention policy, which is fully GDPR compliant. All of our staff undertake regular training to ensure that, as a firm, we respond appropriately to IT and other related risks.
